General Terms and Conditions of Delivery and Payment (GTC)
Scope
By placing an order, the following conditions become part of the contract. In the event of partial invalidity of individual conditions, the others shall remain in force, the contract as such shall remain unaffected.
Prices
All prices include the valid VAT. The prices valid on the day of the order are calculated. If these prices have changed, this will be announced in a written order confirmation. If the order confirmation is not objected to within 14 days of the notification of the order, the customer’s acceptance of the price change will be accepted in a legally binding manner and delivered at this price.
Payments
We request payments in our business premises in cash. Bank-confirmed or LZB cheques are accepted for performance. For foreign cheques, € 15. fees will be charged. In the event of default in payment, we will charge default interest in the amount of 5% via the base interest rate § 288. A further assertion of the damage caused by default remains unaffected.
Delivery modalities
In principle, shipping orders are only carried out by our central warehouse. Please refer to the price table for the shipping costs, since weight - items and depending on the forwarding company. For bulky goods such as barrels, complete brewing plants, shipping is carried out by freight forwarder. You will receive an e-mail with the data in advance. Delivery is only made to house address, no mailbox. Online orders without an email address require telephone number to contact us.
Delivery time
Usually in the short term from stock. For appointments, please coordinate the availability with the sale individually. For delivery execution and delivery date, an order is only binding for us after receipt of the confirmation of our order confirmation signed by the buyer. Claims for damages against the seller are excluded insofar as no gross negligence or intent can be proven to him. Oral appointments are considered not to be made.
Retention of title
Deliveries remain our property until payment of all claims against the buyer from the business relationship, which will continue to arise in the future.
Warranty
For all items purchased from 01.01.2002, we provide warranty 24 months from handover. The receipt serves as sole proof.Not the warranty includes items in which the exclusion was expressly indicated (special promotion sales / perishable goods) or in the case of improper handling of the goods. In the first 6 months after handover, it is assumed that the defect was already present at handover, unless the nature of the item or the defect contradict this assumption. After these 6 months, the buyer is required to provide proof and presentation for a defect. In the case of defective goods, i.e. goods which, according to objective consideration, do not withstand the use agreed after the contract or the expected use, we shall fulfil the defect by replacing the goods or remedy the defect. If the defect cannot be eliminated even after two subsequent performances, the buyer is also entitled to claims for damages if the buyer is entitled to a reduction, withdrawal from the contract or if the seller is at fault. The amount of damage is limited to the value of the item that deals the damage. Further claims are excluded. In case of defect, please write down the required data and send us by fax, mail or mail. Our complaints department will contact you immediately upon receipt. In the case of distance withdrawal contracts, the buyer must also return the right to defective goods without defects within 14 days with the presentation of the receipt unused and in original packaging. This excludes inflatable articles, electronic components, books, CDs, cut-off parts and special orders, used or commissioned items, polluted or unoriginally packaged and damaged goods and goods that would suffer from the nature of the item a significant deterioration due to the return and hygiene articles. Please make sure: We strive for a quick processing, but it can be up to approx. Take 14 days ( return: Mail/incoming goods : Check/Accounting : Transfer ) take until the return is processed. Necessary requests not submitted ! The actual or us in the case of free delivery of goods - also bulky goods surcharge etc. - we charge the return and deduct them from the credit. The return must be free, in the case of justified complaints we reimburse postage costs, if necessary we have the goods picked up. We do not accept non-free shipments!
Acceptance
The Buyer has the right to check the object of purchase at the agreed place of acceptance within 8 days of receipt of the notification of provision and the obligation to accept the object of purchase within this period. If defects are found during the acceptance, they must be admitted in writing to the handover protocol or reported to us. If no entries or notifications are made to us, the goods shall be deemed to have been handed over without defects.
Risk-bearing
When handing over to the carrier, the risk passes to the recipient. All our shipments are insured against a surcharge of 0.5 percent of the value of the goods on request. We ask you to issue a signature on receipt of the goods to unpack the goods and to subject them to an external visual inspection. If you notice damage that is significant, let the goods go back immediately. In the case of minor damage, they will notice the damage on the receipt. Please indicate the damage to us immediately. If you have not logged any visible damage, the burden of proof is unfortunately with you that the damage has not occurred in your custody. Please check your packages very carefully! You avoid inconvenience for you and us.
Error
No claim for performance is derived from printing, writing or designation errors. Such errors are subject to the express reservation of correction. Deviations from the items shown in the catalogue are possible. All catalogue information is approx. Information that has been provided by the various producers. We ask for your understanding that we cannot guarantee this information. In individual cases, you should point out the statements that are decisive for you, so that a concrete review can take place here. In the event of incorrect delivery, we shall only be liable for the replacement of the incorrectly delivered article, we generally assume no liability for consequential damage.
Spare parts and accessories
The installation and use of spare parts and accessories shall be carried out only by experts and in accordance with the instructions of the manufacturers. The built-in or User must check spare parts and accessories before installation in the specific device for accuracy and fit as well as belonging to each other. The correct allocation of devices, accessories and spare parts to each other is only considered to be secured by this installation test. This applies in particular to electrical and pressure or gas appliances, consequential damages cannot be taken over by us and claims can therefore be rejected. If you are not a specialist or are unsure whether and how the spare part or accessories we deliver is installed or used, you leave the repair or installation to us or a specialist workshop, which is not so expensive and you have the guarantee that everything is well set and is perfect!
Exclusion clause
Agreements that conflict with our General Terms and Conditions in order to survive the written confirmation of the managing director or her deputies. Conflicting terms and conditions of the business partner have no stock, this is confirmed to us by the order.
Courtesy
The place of jurisdiction for two-sided trades is the place of the seller.
Revocation policy on the financing contract and distance contract
The customer (if you are a consumer) can revoke his declaration of intent aimed at the conclusion of the contract in writing within a period of 14 days after the signing of the revocation policy to the sepate financing contract or the purchase contract. In order to meet the deadline, the timely dispatch of the revocation to the seller is sufficient. In the case of timely revocation, the associated purchase contract is not effectively concluded. This means that the delivery time is 14 days.
Terms of payment:
Initial orders by direct debit, prepayment, cash on delivery (plus 4,- Euro). After that, also against bill.
Postage and packaging within Germany:
Uninsured book and shipments up to 1kg -3.00 Euro
Insurance parcels up to 20 kg -6,90 Euro
Insurance parcels from 20 kg -30 kg 8,00 Euro
More than 30 kg Shipping by freight forwarder depending on weight and distance on request
Post express and bulky material over 1.2 m length plus 20,- Euro
